Greece to adopt local content requirement

The abovementioned companies assigned the Law Firm “Metaxas & Associates” with the Mandate to deliver a legal opinion on the matter. The legal opinion was then submitted to the competent Greek Ministry; it analyzed the main legal parameters related to the adoption of a relevant measure and focused on the preconditions for the design of support mechanisms based on a “local content requirement” methodology that would render the measures to be compatible with European State Aid and WTO Law.

Following the presentation of the said legal opinion, stating the legal conditions, under which a relevant measure would be compatible with EU Law, the Ministry of Environment, Energy and Climate Change submitted a legislative proposal, which provides for a special premium for energy producers having used European equipment to build their photovoltaic stations.

More specifically, under par. 12 of the Article regarding RES, it is provided for an up to 10 percent increase in the price offered to photovoltaic energy producers, given that 80 percent of the equipment used is manufactured in E.U. or E.E.A. The necessary details regarding this provision, such as the exact increase in the price, the procedure and the terms and conditions for this measure to apply, shall be specified in a relevant Ministerial Decision that will be adopted shortly.
